Tort law is the basis of personal injury cases, and involves instances in which a person’s negligence or recklessness injures another person. In order for a person to have a chance at winning a personal injury lawsuit, that person’s case must meet the following four elements of a tort:
- The plaintiff owed some duty to the defendant
- The defendant breached or broke that duty
- The plaintiff suffered an injury
- The plaintiff’s injury was the direct result of the defendant breaking his or her duty
