
Mother asserts defamation, wrongful felony arrest, public humiliation, and temporary loss of custody following hospital incident

Winston Law (winstonlaw.com) filed a civil complaint in Broward County, Florida, in October on behalf of a mother and her infant son against North Broward Hospital District (Broward Health Medical Center) and other medical personnel. The suit alleges medical negligence and the falsification of hospital records.
The suit, filed in the 17th Judicial Circuit Court, also names Pediatrix Medical Group of Florida, Inc., along with multiple physicians, nurses, and social workers as defendants.
The complaint details that in September 2023, the twelve-month-old son of Ms. Jesus was allegedly administered fentanyl while a patient at Broward Health Medical Center, which led to a life-threatening overdose. The lawsuit alleges that following the incident, medical records were falsified to state there was no documentation of fentanyl being administered during the hospital stay.
The complaint states these records were then provided to the Department of Children and Families (DCF) and the State Attorney’s Office. As a result, Ms. Jesus faced felony child abuse charges.
The lawsuit brings forward multiple counts against the defendants, including medical negligence, gross negligence, defamation, false arrest, malicious prosecution, and intentional infliction of emotional distress. The plaintiff seeks damages of more than $50,000 and seeks leave to claim punitive damages against the individual defendants named in the suit.
